This is a true and accurate account of the treatment I received from Werner Enterprises of Omaha, NE.
I Michael xxxxxxx having been out of work because of no fault of my own, and running out of unemployment benefits used a credit card to enroll in a school to obtain my CDL (commercial drivers license) at the xxxxxxx xxxxx MN. At a cost of $4495.00 Heavy Metal Truck School. Class started Nov. 2nd 2009. They advertised and promised me I would make $45,000.00 in my first year. I graduated Nov. 20th 2009 and passed my CDL driving test Nov. 23 2009. I accepted a pre- employment offer from Werner Ent. as they would repay me for my school tuition $100.00 a month for 12 months and the balance at my one year anniversary if I should last that long.
On Dec. 13th 2009 I was on the bus headed for Werner Headquarters in Omaha, NE. The bus ticket was only good to downtown Omaha so I had to take a cab to the Werner motel a ride costing $40.00 (which I split with another recruit arriving for orientation) I turned receipt in for reimbursement
Upon arriving at the motel I was told I had to share my room with another recruit, (company policy) unless I wanted to pay for the room. As I got ready for bed my roommate strips naked and washes his genitals in the sink where I have to brush my teeth in the morning.
Monday and Tuesday are very long and busy days as we have a lot of information to absorb. We all had to take another DOT physical and I noticed my blood pressure was getting kind of high. I had a physical before I went to Omaha with my Dr. and my blood pressure was 124/68 pulse rate 68, now it was 151/101 pulse rate 68.I will keep monitoring it.
After the two day orientation we all had to wait for a trainer to pick us up and teach us to be truck drivers. Thur. Dec. 17 my trainer called me at 03:00AM my adventure is to begin. I pack and am waiting in the parking lot by 03:30. At 07:00 my trainer pulls in but needs a shower so I can wait in the truck until his return. I notice his English is not very good but his truck is exceptionally clean. I find out later he is from Congo Africa and his language is French. We seem to get along well he is always asking me questions about how things work in America. We drive from state to state in his new truck 2010 Kenworth,.
PAYDAY 1/7/10 GROSS ERNINGS = $13.00
We spend Christmas in Laredo TX. And we both need a shower and a good bed to sleep in so I book a room at a hotel for the night. All goes well and my trainer informs me he is going for home time Dec. 30 2009- Jan. 4 2010 in Atlanta GA. So I book a plane ticket home, otherwise I have to stay in the truck at the terminal with nothing to do or eat. I thought this would be a good time to pick up some tools I had like GPS, laptop computer, CB radio, to show my trainer these things will make navigating easier.
I make it back evening of the 3rd and get a room at the Werner motel in Atlanta. I check in at the terminal at 07:00 on the 4th. My trainer shows up about noon and we wait for a load to haul. At 02:00 we get load info and set out of the terminal, I am stopped at the gate and told I have a safety hold report to safety officer. He was shopping at Walmart so I have to wait for his return. I have to submit to a drug test, why did they wait so long to test me I was sitting around doing nothing all day! I don't do drugs so no worries.
We travel across the states each driving our 11 hours a day until Jan. 9th 2010. We arrived in Laredo TX. Where we tried to deliver our load to the broker but they refused it. I found out later all loads were refused because of some drug lords fighting across the border in Mexico. We wait in the truck on the terminal in Laredo and I show my trainer how the internet works. Tuesday Jan. 12th 2010 we get word we can drop our load at the brokers but do not have a new load to haul yet. We drop the load and stop at a Target Store to eat and I need laundry soap. We park and lock the truck in the parking lot. We went and ate maybe 25 minutes later we come back to find the truck missing. We ask the Target manager if he had it towed? He looked at the video from the parking lot and informed us it was stolen. 14:00+/-

I have receipts for $2478.77 of my personal property that was in the truck, ($3,500.00 actual) I try to get these turned in to get insurance to pay, but Werner says no.
I spend two days in the Laredo terminal answering questions before My student manager Robert W says they will advance me $200.00 from my pay to stay and get in another truck. I say I have no clothes, shower gear, shoes, it is winter time and I have no coat, I want to go home and reassess my trucking career. They put me on a bus for MN and after two days riding I arrive home. I have a 30 day leave of absents.
I try to apply for unemployment and many job postings but nothing works out for me.
PAYDAY 1/21/10 GROSS EARNINGS = $60.86
On Feb. 8 I call and say I am ready to return. I get a call from a trainer at 20:00 that he will pick me up in Pine City at the Walmart store about 02:00.
This trainer works the Walmart dedicated route in Wisconsin and Minnesota. His truck is messy but he speaks English. I finish my training with him in record fashion as I get 11 hours a day to drive(200 hours is what we need to complete training), he's lovin' that.

March 4th I finish my training and go home for 3 days. March 9th I report to Omaha, NE for truck assignment. No trucks available so I do some CBT's (computer based training) to sharpen my skills. March 12th I am issued a day cab truck that needs to be transported to Fontana CA. I ask where do I sleep and am told they will help me find places along the way. I head out to pick up my first load in Aurora, NE. 123 deadhead miles, going to Utah. I pick up the load and find the trailer has expired tags. I call permits to get it faxed to me at Love's truck stop in Aurora NE. Half an hour later I call again they say they sent it never came please send again. Half an hour later I call again same thing, and again I wait for two hours before I get a manager involved, now it comes and my hours are running out fast. I call dispatch, I need a room, they let me know it's not their job to find me a room!.
I see a billboard truck stop and motel at exit 107 Big Springs NE. I know where I'm sleeping tonight. Hours down to less than one!

19:15 Supervisor (Scott) comes on line. He will call the boss at the tow company and get it taken care of

20:00 tow driver gives me a ride to motel and diner.
20:15 (Scott) supervisor calls to ask if freight is in a secure lot, I inform him no but I will watch it

I head for drop yard to pick up load & then I'm headed for Omaha, NE to end this nightmare.
3/17/10
03:00 I message dispatch my ETA to terminal Omaha, NE. will be about one hour And I will need a room
and I'm short of hours.
04:15 I arrive # terminal in Omaha, NE. I am out of hours. I drop the trailer in the designated drop area
leave the bills with the guard, inspect the trailer and tractor and file appropriate macros to
dispatch and maintenance.
05:00 I go to motel (Werner owns) I have no room reserved.
05:15 I call dispatch transferred to supervisor. He says give him a few minutes to email over.
05:30 I check in to motel room is ready. I'm tired going to sleep.
08:00 I Can't sleep I need to contact Ken and get a real truck. My roommate is at training.
08:30 I drive to terminal and turn the keys over to the maintenance garage manager.
09:00 I go to the safety office to check and see if this was all normal operating procedure.
09:10 I talk to Mark the safety officer (I knew from orientation). He suggests that I study some CBT's and
that will help me understand how the system runs. So I do.
12:00 I go to fleet assignment to see about another truck, but Rachel is at lunch so I wait.
14:15 Rachel is back, she informs me they have no trucks for me except the one I turned in.
14:30 I talk to Ken my dispatch, I tell him that I need some sleep.
15:00 I'm so tired I just head for the motel to sleep. My roommate just left with his trainer.
18:00 I am woke up in my room by the motel desk clerk, they received a call from a manager at Werner
to move me to another room. I pack up all my things and am escorted to another room, next
door?
19:00 New roommate has 100's of questions but I inform him I'm tired and need sleep. He turns on the

21:00 Roommates' phone rings, his trainer calls to inform him he will pick him up in a few hours. TV is

08:40 I apologize to Ken and tell him if Rachel will give me roller skates and he gives me a backpack

09:20 Ken calls me says he has a load for me, go see Rachel at fleet assignment.
09:25 I'm at fleet assignment. I am told this is the only truck available for me, day cab.
09:45 I inspect the truck & fuel it up.
10:00 I send Ken the Macro 26. (ready for a load.)
11:30 I arrive at Aurora NE. 123 deadhead miles. Load going to Buckeye AZ. 1214 miles
22:30 I arrive at Eads Colorado nothing here except an abandoned gas station. 3 other trucks parked so I pull in and try to get some rest. Sleep in day cab no choice.

08:30 freezing rain icy roads starting to move. Very bad roads many spin outs. Mountain driving.
19:30 Out of hours Gallup, AZ. Staying at a TA Motel # truck stop. $36.13 a night.
22:00 FIRE motel is on fire! Sit in parking lot and watch the fire fighters work.

12:20 I am given a list of 8 trucks that if I will get it fixed and accept it, it will be my truck ( 10 other
drivers get the same list). I pick one out and get there first.
13:30 after inspection I find severe radiator leaks, large spikes in the drive tires, front bumper is broken
and hanging on with ropes. Top wind fairing is broken off, passenger mirror glass is gone, exhaust
pipes are not connected. Cigarette burns in the seats, AND the brakes failed. Truck #
mileage- 262,320. I refuse this truck. Most of the others are back with refused trucks also.

4/8/10 GROSS EARNINGS = $0.00 STUDENT REIMBUR. = $100.00 ADVANCE REPAY = $92.35
Pay day comes and all but two motel rooms are re paid to me I call again to Ken and he wants me to quit?? Why?? I tell him to get me my money back. Next payday my student tuition money is to be paid to me but it is marked as a repayment for a $1113.00 advance payment charged to me. (The tow!!)
I call Ken again and tell him to get this straightened out I have to pay the credit card before the interest starts. The next pay day comes and I get the room from Phoenix AZ. Refunded but it is kept to pay off the $1113.00 advance (tow!) I call payroll and they tell me I am not an employee anymore. I ask as of when was that and she tells me as of April 16, 2010. And per Tony H Director of operations. I have to pay Werner $180.60 per week till the $1113.00 bill is paid. I ask how my mileage was figured and she tells me I was getting $0.25 per mile but because I was getting per diem Werner takes $0.01 per mile off and I get $0.12 as per diem and $0.12 as taxable pay.

4/22/10 I call Ken again and he does not know me? He needs my full SSN# and employee #. He says he will look this up and see what if anything needs to be straightened out. He will call me tomorrow.
4/26/10 I am writing all this as accurately as I can most of this is written in my notes. Ken has not called me. How deep are my pockets? I have more invested in this job then I can make in a year at this rate. If what I heard is true=the government pays Werner up to $10,000.00 for training students and after they deliver one safe load Werner gets the money to pay back the student for their CDL school. If the student is not still employed at the end of the year Werner gets to keep the money! The schools are run just like a puppy mill hundreds of students per week. That is why they have no trucks and the trucks they do have are vandalized by disgruntled employees.

My loss in stolen truck = $3,000.00
My advance re pay ? = $936.40
My total loss.........=$7,517.31
I want everyone to know that my wife was there for me every minute of the way (on the phone) She booked the rooms for me followed my path directed me around severe winter storms to keep me on time, and supported me threw the worst time of my life. I was in the USMC during combat and never had this much grief.
My wife's employer has shut down and moved to China, so we are both unemployed she will get unemployment but I will not as Werner has listed me as a quit. We are about to miss our first house payment and not sure what our futures will bring.
